Trademarks are examined by the TPI examiners prior to their publication, in consideration of the 7th and 8th articles of the Decree Law No.556, pertaining to the absolute and relative grounds of refusal.
Unless any grounds for refusal have been revealed during examination, the trademarks are published in the Official Trademark Bulletin for opposition/observation purposes. Publication term is 3 months starting from publication date. Any natural or legal person or any group representing manufacturers, producers, suppliers of services, traders or consumers may submit to the Institute their written oppositions / observations that the trademark does not conform to the registration requirements even they are not party to the proceedings before the Institute.
International trademarks applications designating Turkey are also treated as the national applications. Like national applications, they are examined as of relevant articles of the Decree Law pertaining to the absolute and relative grounds of refusal and published in the Official Trademark Bulletin for 3 month-period.
According to the relevant articles of Decree Law No. 556, persons who are damaged from unfavorable administrative decisions have the right of objecting to these decisions before the Higher Board Re-examination and Evaluation of the TPI. Such appeals should be filed to the TPI within 2 months as of the notification date of the said administrative decisions.
