Internet Domain Name Rights


Internet, one of the most important inventions ever, influenced the life at all points. In line with the quick proliferation of internet use, legal problems are increasing concerning internet domain name registries. 

Internet domain name registries, ending with extensions like .com and .net are performed by various companies under the supervision of ICANN with the “first applicant takes” rule applied. Various right losses are occurring due to buying of Internet domain names by persons other than the real right holders. Domain names, purchased very cheaply by malicious individuals may be sold to the domain name holders or other persons with excessive prices and become subject to unlawful profit.

In such situations, one should seek legal action. When a positive reply can not be received through a protest, a cautionary junction verdict may be requested within the frame of the provisions of unfair competition or trademark violation.

Additionally, for the cancellation of domain names, the transfer of domain to right holder of the domain name may be enabled through an application to International Arbitration Center at World Intellectual Property Organization, ODTÜ, the sole institution authorized to register domain names ending with the extension .tr, demands from applying individuals or organizations documents like brand registry document and commercial registers. This implementation enables to minimize the number of malicious registries concerning domain names ending with the extension .tr.
